before any generalizations tignan muna natin yung basis.
Yes! si DU30 is against Rappler pero kasi may basis yung "control" issue ng PDR to Rappler.
kung wala yung "control" provisions na yun eh di sana walang naging basehan ng suspension.

parang ganito lang yan. may kagalit kang officemate. eh parati kang late. sinusumbong nya yung tardiness mo. kahit alam mong loko-loko yung officemate mo pero kasi tama yung paratang sa iyo at may basis syempre mape-penalize ka. nakaganti sya sa iyo via legalities and policies.

in a similar fashion ganun ang nangyayari. nagpabaya kasi ang Rappler.

I'll let the legal minds determine whether what rappler did is unconstitional or not. I've read enough literature out there and nothing has convonced me that this is anything but harassment.

We are at the point where we dont even need to make generalizations. We can already make conclusions. The simple conclusion is that any insritution critical of the government will receive harassment, and will be threatened with the elimination of their fundamental rights.

The Prietos were forced to sell inquirer. Rappler is being shut down. Abs cbn is being harassed.

Beyond that lawmakers, the CJ, and Ombusman, who have dissented against the President are all facing some sort of harassment.

Duterte said this himself:

“I’m challenging you, guys. Kill journalism, stop journalism in the country. If you are worth your salt, you should accept the challenge.”

Doesn't take a rocket scientist to see what this is.

yes I agree na harassment. pero kung babasahin mo analogy ko, officemate mong kagalit (alam mong maloko) meaning he is at fault at something... in other words yung nangha-harass man sya pero may basis. sana kung wala. gets?!

kung may fault ang rappler kasalanan nila.

ganito na lang gagamiting kong words para makuha mo. si Duterte may mga kasalanan kaya kayo galit , I'll agree with that. pero nakakita ng butas, nakakita ng butas ay iba sa gumawa ng butas. meaning may basehan ang SEC.

so magkakatalo na lang ito kung ang totoo yung nakitang butas o gawagawa lang nya. either way harassment pa rin.

so tanong ko na lang sa iyo, totoo ba paratang ng SEC?

si kung ako tatanungin mo kung totoo, hindi ko alam. bilang fence-sitter sa poltical issue ito hindi ko masasgot yan. kasi kung yung mga anti-rappler ang sasabihin "ah totoo yan PDR with control na yan". kung anti-Duterte naman ang sasasbihin "ay gawagawa lang yan".

So for me, at this point, making a conclusion one way or another on whether this is unconstitutional or not will send us into a rabbit hole where we would just be arguing about semantics. But if you want a sample, here you go:

(UPDATED) The Securities and Exchange Commission (SEC) en banc decision revoking the certificate of incorporation of Rappler Inc. and Rappler Holdings Corporation violates the freedom of the press. The SEC’s resolution stated that the scheme by which the two companies allowed foreigners to invest in Rappler is in violation of the constitutional foreign equity prohibition on mass media.

But is there a violation?

None. The resolution is a stretch if only to make the situation fall within the ambit of the 1987 Constitution’s proscription on “ownership and management” by foreigners of “mass media.”. The SEC arguments do not provide a solid basis for unconstitutionality.

Kung iaaapply mo yung law sa Rappler, why not apply the same kind of thinking sa renewal ng Congressional franchise ng Smart? Their congressional franchise was renewed last year despite Smart's inability to follow IPO rules on their congressional franchise. That's why we're beyond the point of making any claims about generalizations. This is a specific attack on freedom of speech. Freedom of the press. And freedom of expression.
